Overtime Claims
The Fair Labor Standards Act (FLSA) requires employers to follow federal minimum wage and overtime laws. Congress’ purpose when enacting the Fair Labor Standards Act was to ensure fairness for workers and to protect all covered workers from substandard wages and oppressive working hours. One way Congress attempted to effectuate this goal through the FLSA was by warranting a minimum livelihood to the employees covered by the Act. In simpler terms, Congress sought to prevent employers from taking advantage of employees by making them work long hours for substandard pay.
Employers often misunderstand and misapply the rules and other employers actively violate the rules to save money at the employee’s expense. Very few businesses are immune from requirements of the Federal Fair Labor Standards Act (FLSA). It applies to all employees of certain enterprises regardless of the work they perform. If you have been working over 40 hours per week but not paid overtime, your employer may have violated the law, and it may be your right to bring a legal action against him or her and recover the wages that you are owed. Many employers intentionally or negligently misclassify workers as salaried employees to avoid paying overtime. Even if you are a salaried employee, you may still be entitled to overtime pay.
